The Attorney General of the Republic, Roberto Gurgel, filed in the Supreme Court (STF) a direct action of unconstitutionality (Adin 4895) against provisions of Law 12.550/2011 authorizing the creation of the Brazilian Hospital Services (Ebserh).

Under the Ministry of Education, Ebserh is a public company legal personality under private law and its own patrimony. Thus, university hospitals are subordinate to universities academically, but are administratively independent. The company will be headquartered in Brasilia, with capital fully subordinate to the Union

The Ebserh aims to manage financial and human resources of the university hospitals. According to a statement from the PGR, in evaluating Gurgel, the law violates constitutional provisions assigning the company to provide a public service.

According to the attorney general, the law violates the Clause 19 of Article 37 of the Constitution, which provides that the institution of a public company may be authorized only by specific law, while the law further define the areas in which this company.

Gurgel also pointed out the fact that the activities of providing health care services being inserted fully and exclusively within the Unified Health System (SUS) is in harmony with the Law of the SUS (Law 8.080/1990).

Hiring servers based on the Consolidation of Labor Laws (CLT) and hiring through temporary contracts and simplified procedure are also challenged by the attorney general.

The Minister Antonio Dias Toffoli is the rapporteur of the case in the Supreme Court.

Currently, the 46 university hospitals linked to 32 federal universities are responsible for the formation of a large number of medical professionals in the country. In certain regions, the hospitals are more important than public health service and play a critical role in the consolidation of SUS, since 70% of the units are considered large and have high complexity care profile.

Interessante, em muitos hospitais municipais e postos de saúde, firmam contratos com ONGs, para gerenciar e contratar profissionais. no Município de Prudentópolis, a Saúde "estava" subordinada a ONG ORDESC/Curitiba. e a planilha de custos, dos profissionais, apresentava absurdos. Ex: Técnico de Raio X, salário R$ 4.000,00 (30h/s) Na Lei de Cargos e Salários do Município R$ 760,00. Vigia 2.900,00 no Município Salário Mínimo...Nem o Ministério Público, nem o Tribunal de Contas do Estado do Paraná, se interessaram em averiguar o Contrato.....
